What Is Alternative Dispute Resolution?

Alternative dispute resolution is an area of law that finds ways to settle cases without going through a trial.

  • Arbitration - Arbitration is a process through which a case is presented to an arbitrator (often a retired judge or experienced family law attorney) who makes a decision about how the case should be settled. Arbitration is binding (meaning whatever the arbitrator says is the final solution) and the decision becomes the judgment of the court.
  • Mediation - Mediation is another form of alternative dispute resolution favored by our attorneys in which the attorneys for the parties select a neutral individual, usually a retired judge or senior family law attorney, to meet on a given day or two to get to know the parties, their concerns and their goals in the family law matter. The mediator and attorneys work with the parties to find a mutually acceptable solution. Mediation is common for divorce but can also be used to resolve other family court issues (such as child support or custody). The American Academy of Matrimonial Lawyers has certified Attorney Siegel as a divorce mediator and he is available to mediate family law disputes by Zoom or in person.
  • Collaborative divorce - Collaborative divorce occurs when the spouses and their attorneys work with each other to reach a settlement without using litigation.
